Reforming the Australian Criminal Justice System in Relation to the Use of DNA Evidence
We at Behlau Murakami Grant ILP have been known for our work with the internationally renowned Griffith University Innocence Project. This work has included negotiating with the Queensland Government to establish Australia’s first guidelines for post-conviction DNA testing, to testing for the first time in Queensland history, DNA evidence for a claim of wrongful conviction.
We have also worked closely with public forums involving Police Commissioners, Judges and criminal defence lawyers questioning the use of DNA in the criminal justice system. Our involvement in DNA extends to the current Queensland Government calling an Inquiry into DNA evidence later this year, which will be presided over by former Court of Appeal Chief Judge, Walter Sofronoff QC.

State Recognition As A Leading DNA Lawyer
Recently, our very own Criminal Law Division Partner, Ron Behlau was recognised as one of the state’s leading DNA lawyers. Ron has been called upon by the Queensland Law Society to present at their 2022 Criminal Law Conference to discuss the upcoming Inquiry into DNA and the ramifications for defendants who have been charged with or convicted of criminal offenses utilising DNA evidence. Behlau prepared a presentation entitled “The Defence Lawyers Pre-Trial DNA Bible” as a guide to ensuring that prejudicial DNA evidence does not go before juries and judges to prevent possible miscarriages of justice.
