One partygoer has landed in hospital and another has gone to jail after a fancy dress party at a Gold Coast waterfront mansion erupted into an ugly fight.
The incident dragged both parties through court and now one of the partygoers has spoken out, saying it was “one of the scariest moments” of her life.
“It was like all hell broke loose,” Angelina Jennings told A Current Affair.
“It’s horrible, it’s destroyed us, it’s literally ripped us apart,” her husband Michael Healey said.
And so yet another matter dragged through the courts, with the magistrate reviewing video footage of three different incidents where Mrs. Carlson claimed she was scared and afraid of Healey, before throwing it out and awarding costs against Mrs. Carlson.
Healey was represented by a leading criminal justice lawyer, Ron Behlau of Behlau Murakami Grant.
“My client has been completely vindicated. Mrs. Carlson’s evidence was rejected by the Magistrate in favour of Mr. Healey’s evidence. Mr. Healey can now put this ordeal behind him, ” said Behlau outside of court.
Although Snow White and Superman, are generally costume characters that might guarantee a fun time, for Healey and Jennings, they said their invite to a birthday party ended up being the furthest thing from a fairytale.
The couple had only recently moved from New Zealand and were excited to make new friends, but they said after arriving at the party they sensed something wasn’t quite right.
The couple said things began to feel a bit “weird” when they noticed people had their arms around each other and were whispering to one another.
But despite feeling uncomfortable, the couple said they decided to stay until the DJ finished at 10pm.
They said they decided to hit the dance floor, but things quickly turned ugly for them when another party-goer pushed Healey from behind.
“The next minute he cracks him in the back of the head and Mike just literally hits the deck and I went over to check on Mike and he (the other man) started hitting me,” Jennings alleged.
While Healey was out cold and severely injured Jennings said she dealt with the chaos that unfolded.
“It was like fight or flight. I didn’t know what was happening and I didn’t know if Mike was alive or dead. He was on the floor and yeah it was, it was just horrible,” she said.
Jennings claims police were called but never showed.
An ambulance arrived 20 minutes later and took both Healey and Jennings to the Gold Coast University Hospital where a CT scan revealed Healey had fractures to his facial bones and skull, as well as serious bleeding on his brain.
“All of these things have huge ramifications in terms of headaches, migraines, neck pain, back pain; eyesight. This is just on the physical side,” Healey said.
The next day police took statements from the couple and the offender was identified.
Daniel Richard Carlson who initially hid from police, later handed himself in, before being charged with grievous bodily harm and actual bodily harm.
The matter dragged through the courts for more than two years, until the offences were downgraded to assault occasioning bodily harm and common assault.
Carlson was eventually sentenced to three months behind bars and a nine-month suspended sentence with a conviction recorded.
“He’s a criminal and he’s nothing more than that … and he got to have a three-month holiday and then walk out Scott-free – no parole, no checking in at the police station, nothing,” Mr Healey said.
Carlson is also a New Zealander and the father-of-two now resides streets away from Healey and Jennings, with his wife Bree Carlson.
A Current Affair confronted Carlson and asked why he punched Healey at the party, but he refused to answer.
Healey and Jennings said they are still unsure what sparked the assault but added they’ve never been in trouble with the law.
Healey and Jennings also claimed that while Carlson was in prison, his wife issued a peace and good behavior bond against Healey – claiming she felt threatened by him.

“We’ve been fighting for three years,” a relieved Healey said outside court.
While the legal battles are over, Healey and Jennings said their lives have been changed forever.
“It has destroyed me; it’s broken me down into a tiny shell of a human being. I don’t know who this person is, my kids don’t know who this person is, Angelina doesn’t know who this person is and it turns on a dime,” Healey said.
Healey now takes medication daily and has been told he will never work again.
“If only there had been one iota of remorse shown or an apology or anything, but in fact it’s been the opposite. They have come after us for pursuing justice for what happened to Mike,” Jennings claimed.
“There has never been an apology.”
